When purchasing a ticket to our retreat, you agree to the following terms, conditions, and policies.

 

BOOKING TERMS & CONDITIONS

Awakened Soul Retreats are for accommodations only. The attendee is responsible for purchasing airfare, traveling to and from the retreat, and travel insurance.

TRAVEL INSURANCE

No one books a retreat to cancel it. Still, unexpected events do occur, so please consider purchasing international travel insurance, and note that it is your responsibility to read and understand our cancellation policies. Exceptions cannot be made for any reason, including weather, injury/illness, or personal emergencies. There are no refunds or credits for failure to attend or complete the retreat for arriving late or leaving early. We recommend that you purchase travel insurance. We encourage you to purchase trip cancellation insurance to cover your trip fees should you or your family have a medical problem before or during the trip. Trip insurance should also be purchased to cover medical expenses if you have an accident while on the retreat. Most travel insurance must be purchased within 14 days of making your reservation. We reserve the right to cancel retreats with inadequate participant interest, in which case all money paid to Awakened Soul Retreats will be refunded. For this reason, notification of cancellation will occur at least one month before the retreat start date. Awakened Soul Retreats cannot be held responsible for personal expenses, such as airline tickets,  due to itinerary changes or retreat cancellations.

 

CANCELLATION POLICY

Please note that because Awakened Soul Retreats are limited to a small number of attendees, to allow for a more personable, intimate experience, our cancellation policy is in place to help guests and us alike work together, sharing expenses that may arise from unexpected cancellations.

1. If you cancel or postpone your booked retreat date, Awakened Soul Retreats does not offer refunds. A portion of your payment may be used as credit for another Awakened Soul Retreat date and package. The total dollar amount is applied to current rates. Any credit must be used within two years of the original retreat date.

2. Depending on when you cancel, cancellation penalties may apply.

 

The following schedule determines fees:

• If you cancel over 180 days before your Awakened Soul Retreat package start date, 100% of your payment may be applied to another Retreat.

• If you cancel 179-90 days before the start date of your Awakened Soul Retreat package, 50% of your payment may be applied to another retreat. You will forfeit 50% of the price of your retreat.

• If you cancel 89-60 days before the start date of your Awakened Soul Retreat package, 25% of your payment may be applied to another retreat. You will forfeit 75% of the price of your retreat.

• You will forfeit your entire payment if you cancel 59 days or less before the start date of your Awakened Soul  Retreat package.

 

***Please note that any credit dollar amount from a cancellation will be applied to the retreat’s current rate at the time of re-booking.

 

DISCLAIMER & POLICIES

 

DISCLAIMER

1. Awakened Soul Retreats and all persons involved in retreats (from now on referred to as "AGENTS")   act only in the capacity as AGENTS for the participant in all matters connected with travel,   sight-seeing journeys, and transportation, and as AGENTS hold themselves free of responsibility for any damage occasioned by any cause. AGENTS will not be responsible for any damages, expenses,   or inconveniences caused by late departures or change of schedule, strikes, or their conditions, nor will they be responsible for loss or damage to baggage or any of the participant's belongings. All prices quoted are correct at the time of printing, include the cost of operation of the journeys, and are subject to currency changes. AGENTS shall not be responsible for personal injury, death, accident,   delay, loss, damage, irregularity, or property damage as a result of force majeure or for any other losses or damages incurred by any person or journey participants caused by any delay or change of itinerary or arising out of any act, including, but not limited to, any act of negligence, any person acting for or on behalf of AGENTS for transportation, accommodation or sight-seeing provider or any other person or entity rendering any of these services or accommodations being in connection with this journey.

2. This agreement supersedes all previous oral or written communications, representations, or contracts between the parties. Participants assume the risk involved when participating in yoga,   foreign travel, and any activities and pursuits voluntarily undertaken during the retreat.

3. Participants agree that any disputes between Participants and Awakened Soul Retreats shall be governed by South Dakota law. Participants agree to mediate any disputes before the institution of any litigation. In the event of any litigation between the Parties to this agreement involving their respective rights or obligations, such litigation shall occur in Minnehaha County, South Dakota, and the prevailing party shall be entitled to recovery of reasonable attorney’s fees and court costs of litigation. Regarding the stay during the retreat, AGENTS will provide safe, careful instruction and safe premises but ask that each participant take personal responsibility for self-care and (in the unlikely case) for any injuries incurred during the retreat. Modifications are given to students with specific needs. If participants are unsure of their physical ability due to previous injuries, they should seek a healthcare practitioner's advice beforehand.

 

PHOTO POLICY

1. By participating in a retreat, guests acknowledge and agree to images and photos of their being and likeness being taken by Awakened Soul Retreats and other participants and that such images may be shared at will online and publicly.

 

PRE-EXISTING CONDITION DISCLOSURE POLICY

1. If you have a pre-existing substance dependence, eating disorder, psychological (phobias,   traumas), or significant medical conditions, please know that Awakened Soul Retreats is not a   medical or rehabilitation facility. Awakened Soul Retreats offers no medical or psychological recovery or rehabilitation assistance for these conditions. We are a holistic wellness retreat offering natural therapies and experiences for general well-being. Suppose you have a pre-existing disease that may affect your physical or mental experience on the retreat or your interaction with other guests or our team. In that case, we ask that you inform us of this when booking. This is important so we can help assess if an Awakened Soul Retreat suits you. Suppose any pre-existing condition is not revealed to us at booking and later puts you, or others, in a situation of inability to provide adequate care or alleviate discomfort. In that case, we retain the right to cancel your retreat without giving a refund or credit, forfeiting all payments.

2. I recognize that Awakened Soul Retreats practices may require physical movement and exercise,   including stretching, breath work, yoga, and dance. I am fully aware of the risks and hazards involved.

3. I represent and warrant that I have no medical condition that would prevent my participation in the retreat. I understand that I must consult a physician before and regarding my participation in Awakened Soul Retreats practices.

4. It is advisable to consult a physician before participating in any activity. If I have consulted a   physician, I confirm that I have taken the physician’s advice. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured. I confirm that I  am in proper physical condition to participate. I understand that although I may be given specific advice or suggestions about making physical activity safe, it is my responsibility to make my own decisions and to take appropriate actions based on those decisions.

5. I declare myself responsible for my health and safety while participating in Awakened Soul   Retreats practices and courses.

6. My representative(s) or I agree to fully release Awakened Soul Retreats from and against any claims or liability of whatever kind or nature arising out of or in connection with residential training provided by Awakened Soul Retreats.

7. I understand that the practices offered within Awakened Soul Retreats do not serve as a substitute for counseling, psychotherapy, psychoanalysis, mental health, and primary care. I also know that the information and services offered and or received in Awakened Soul Retreats practice do not constitute a medical diagnosis, treatment, or medical prescriptions.

8. I agree that I shall not in any way conduct myself inappropriately or take inappropriate advantage of the personal and professional training made available.

9. I acknowledge and understand that I use the accommodation and facilities provided for Awakened Soul Retreats at my own risk. In consideration for being permitted to participate in the training, I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the training offered and my presence at the premises at which Awakened Soul   Retreats practices are presented.

10. I expressly waive any claim I may have against Awakened Soul Retreats, its officers, employees,   agents, contractors, and affiliates collectively for injury or damages I may sustain arising out of my participation in services or my presence at the premises. I expressly waive any liability claim for personal/bodily injury or damages that occur to me or anyone accompanying me. I also waive any claim for loss, damage, or destruction of my personal property or the property of anyone attending me. This agreement is intended to constitute a complete release of any responsibility for personal injuries and property loss/damage sustained by me or anyone accompanying me while attending the residential course, whether engaged in the offered services or not.

 

Awakened Soul Retreats practices don't claim to or are limited to:

• Treat physical diseases and disorders of the uterus or reproductive system

• Treat menstrual conditions or menstrual pain

• Treat mental health disorders, including PTSD and depression

• Restore or augment fertility or form part of fertility treatment

• Form part of a crisis response to any traumatic event.

 

Awakened Soul Retreats practice is not a substitute for and is not limited to:

• Medical diagnosis and treatment

• Fertility treatment and interventions

• Postpartum Diagnosis and Intervention

• Psychiatric Diagnosis and Treatment

• Trauma Diagnosis and Treatment

• Crisis counseling and treatment

• Psychotherapy or counseling

• Holistic/alternative therapies
